All deposits required are based on the payment due dates table below to secure and hold the booking.

Payment may only be made by wire transfer and check. Checks can be made payable to IWorld of Travel and either emailed for electronic processing or mailed with tracking number.

Itinerary Changes

You can count on the value of IWOT’s experience and regional knowledge to make sure you enjoy your cruise even when conditions beyond our control occur. The very nature of sea voyages means that there will be times when weather or other conditions in a region will require IWOT to adjust or modify an itinerary. Although every effort will be made to keep itineraries, vessels, and hotels as they are shown in the itinerary, IWOT reserves the right to substitute itineraries, hotels, or vessels. In such cases, we will do everything we can to make sure the locations visited, the excursions, hotels or vessels offered are like our initial itinerary inclusions. Any changes to itineraries will not result in eligibility for a refund. Itineraries are subject to change without notice and may need to be altered specifically because of weather, wind factors, or other conditions.

 

Cancellations

All payments and contract are non-cancellable and non-refundable, and full charter payment due, whether ship sails or not.

Baggage Fees, Baggage and Personal Belongings

IWOT allows two (2) suitcases, one (1) carry-on bag, and one (1) personal bag (handbag, computer case, etc.) per person onboard our ships and motorcoaches. Airlines may have additional baggage restrictions and may impose additional fees for checked baggage and/or excess baggage. Keep an eye on your baggage–it is your responsibility throughout the trip. IWOT is not responsible for loss, theft, or damage to baggage and/or personal belongings at any time during the cruise, or on included transfers and other transportation.

 

Advanced, Cancelled, or Delayed Sailing

IWOT reserves the right to cancel, advance, postpone or modify scheduled departure, return or itinerary dates, as well as locations, events, and schedules, and may, but is not obligated to, substitute, vary, alter, reschedule, cancel and/or relocate any accommodations, vessels, modes of transportation and other aspects of the vacation. IWOT is authorized to take these actions due to causes or circumstances of any kind or nature beyond IWOT’s control or causes or circumstances within IWOT’s control that IWOT deems to make such actions appropriate. IWOT will not be liable for cancellation, delay, rescheduling or other adjustment or impact to a departure or itinerary, or other aspects of the vacation brought about due to “Force Majeure,” meaning and including but not limited to war, or warlike conditions, terrorist activities, breakdown of engines and equipment, fire, perils of the seas, storms or other weather-related occurrences, earthquake, flood, vandalism, destructive acts of God or of Governments, legislative enactments, embargo, riots, civil commotion, strikes, lockouts, pandemics, and all other circumstances beyond its control that prevent or interfere with any aspect of the cruise/tour, also including governmental and administrative actions. Circumstances known to the parties at the time of signing this charter agreement do not constitute Force Majeure. Circumstances that occurred between the signing of this agreement and the date of commencement of the itinerary (Embarkation) shall be dealt with commercially and amicably between the parties by a separate agreement. The process to be followed in such a case may include a third party’s professional advice or in case of escalation initiating a formal arbitration process.

 

Pre & Post Land

For any pre or post land services wishing to be added, directly before or after a cruise or group travel package, supplemental deposits and payments will need to be paid in addition to those required for the charter.

 

Extensions/Land Tours

IWOT reserves the right to reschedule and/or cancel land extensions or land tours if the minimum number of participants (10 people) is not met or for safety reasons.

 

 

Arrivals

On the day of embarkation, your stateroom will be ready after 1:00 PM. Guests who embark prior to 1:00 PM can store luggage or wait in one of the public areas onboard. For itineraries beginning at a hotel, your room will be ready after the hotel’s standard check-in time. IWOT is unable to request early check-ins.

 

 

Departures

On disembarkation day, guests must vacate their staterooms by 10:00 AM. For itineraries ending at a hotel, you must vacate your room by the hotel’s standard check-out time. IWOT is unable to request late check-outs.

Travel Insurance Recommendation

We strongly encourage you and your clients to purchase travel protection when traveling. Should you choose to travel with IWOT without travel insurance coverage you and your passengers acknowledge your agreement to take full responsibility for all expenses (trip interruption, trip delay, medical expenses, quarantine expenses and emergency evacuation/repatriation) that may arise while traveling.

 

 

Security

Security and safety are major concerns to all of us and the global situation is constantly changing. Events around the world, coupled with the “Travel Advisories” put out by various governments, may at times necessitate changes to the accommodations and itinerary or even trip cancellation. Risks are involved in travel to any country that may experience security difficulties. You must accept these risks and assume responsibility for your own travel decisions.

 

 

Ship Rules

Passengers on board are obliged to abide by the ship rules, as the captain is responsible for the safety of all passengers and the crew. Jumping and diving from the boat during navigation, as well as climbing on the masts, is forbidden. Swimming far from the boat or the coast should be avoided. It is forbidden to throw rubbish into the sea. It is not allowed to bring drinks and food on the boat, except personal care products, liquid medicine, food products for infants and special diets. The ship’s captain has the right to remove any guests who become unruly, threatening, or behave in an unsafe manner. In such cases, these passengers will not be entitled to any refund.

 

 

Health and Mobility

We strive to provide a safe, enjoyable, and memorable travel experience for all passengers. To this end, all passengers must ensure they are medically and physically fit for travel and accept responsibility for being in good health; able to walk, climb steps, enjoy full sightseeing days, and easily transfer to airplane or car/van as needed. In addition, please note the following:

We welcome passengers with special needs or disabilities, however, as many sites are not accessible to the physically challenged, those needing wheelchairs, oxygen, or other ambulatory assistance will find the tour extremely limiting in their experiences. Guests with medical needs of a physical nature should bring a personal attendant to assist them. Passengers must advise IWOT at time of booking any physical, medical, or other special needs that require accommodation. Please request the Special Needs form so we can help assess and assist you with passenger needs. After booking, should a Passenger develop a physical or medical condition that requires accommodation, they must advise IWOT immediately.

IWOT may impose safety requirements necessary for the safe operation of the tour, cruise, and land tours from the cruise. IWOT may also exclude an individual from participating in a tour or an activity if that individual’s participation poses a direct threat to health or safety.

IWOT does not provide personal devices (such as wheelchairs, hearing aids or prescription eyeglasses) or services of a personal nature (such as pushing a wheelchair or assistance in eating, toilet, or dressing). A companion capable of providing such assistance must accompany any passenger who requires services of a personal nature.

IWOT does not employ medical personnel. Any necessary medical attention will be provided by a local facility at the passenger’s expense. IWOT is not responsible or liable for any losses or costs incurred because of medical services obtained while on the cruise or on land, or for the quality of the care or services received.

Passengers should be aware some land tours include rough terrain, extensive walking over cobblestone streets, uneven pavement, stairs, and locations which may not be easily accessible or accessible by wheelchair. During the tour, IWOT may decide with independent suppliers to provide travel services. These parties are independent entities over which IWOT has no control. Accommodations on international tours or cruises may differ from those in the United States. IWOT cannot guarantee disability access or accommodations for passengers traveling on international tours. IWOT may, in its sole discretion, decline the booking of any passenger or remove any passenger who cannot comply or refuses to comply with the IWOT terms and conditions. IWOT is not responsible for any costs incurred if a passenger is removed from a tour. Passengers agree not to hold IWOT or any of its related entities liable for any actions taken under these Terms and Conditions.

Responsibility and Waiver

The responsibility of IWOT is limited. IWOT promotes and sells tour programs consisting of certain travel services on cruise ships (“Vessels”) or other modes of transport (“Transport”). IWOT does not own or operate any of the Vessels/Transport. The owners, operators, and charterers (“Suppliers”) of the Vessels/Transport are independent of IWOT. IWOT makes no representations or warranties concerning the Suppliers or the Vessels/Transport. IWOT assumes no liability for any acts or omissions of any Supplier including, without limitation, those involving cancellation of tours/cruises, schedule changes, rerouting, delays, damage to or loss of baggage, property damage, equipment failures, accidents, death, or injuries to persons regardless of cause, whether services tendered, or transportation provided are arranged through IWOT.

Accordingly, you will not have any right to claim or recover against IWOT because of any negligent or willful act or failure to act of any Suppliers or the condition or operation of any Vessels/Transport. Notwithstanding anything herein to the contrary, the liabilities and obligations of the Suppliers to you and your rights against the Suppliers, are subject to any and all Terms and Conditions of the Suppliers’ contract of carriage and any and all governmental/jurisdictional laws and regulations bearing upon or otherwise relating to such rights, liabilities and obligations, including, without limitation, choice of law, jurisdiction of disputes, limitations of liability and limitations on the time to file claims. By utilizing the travel services of the Suppliers, you agree that you will look to such Suppliers for any accident, death, injury, property damage, or personal loss to you or to those traveling with you, and that neither IWOT nor any representative of IWOT shall have any liability whatsoever.

Additional risks and dangers may arise including, but not limited to, hazards of traveling in undeveloped areas, hazards of travel by boat, train, automobile, aircraft and other means of conveyance, animal interactions, forces of nature, political unrest, other unrest, hazardous local customs and practices, differing levels of sanitation, differing standards of safety, risks associated with water, food, plants, insects and differing animal regulation, accident or illness in areas lacking means of rapid evacuation or medical facilities, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept all risks. As lawful consideration for the agreement with IWOT to participate in such trips and activities you agree you will not make a claim against IWOT, its related companies, or its personnel, or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release IWOT, its related companies and its personnel from all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors accompanying you. This agreement also binds your heirs, legal representatives, and assigns.

 

 

Responsibilities & Obligations of the Travel Broker, Charterer, and Passengers

  • The Carrier is obliged to comply with orders or instructions of the Authorities, to change ship’s route to save human lives or property at sea, to obtain medical assistance and to safeguard the safety of the passengers, the ship’s crew and of the environment.
  • The Charterer is responsible for any violations of laws and regulations, damages to property, loss or expenses incurred by his personnel, agents, representatives, and passengers and hereby indemnify the Travel Broker and Carrier in this respect.
  • The Charterer’s passengers, personnel, representatives, etc. are always required to follow the captain’s instructions as to the ship’s operation and the safety on board.
  • It is the Charterer’s responsibility to ensure that all his/her passengers are holders of a valid passport, visa, and documentation in general for visiting the countries and places described in the itinerary. Any such failure shall not constitute a valid cancellation and refund reason.
  • The Charterer is responsible to timely communicate to the IWOT or Carrier any concerns and/or complaints arising from its passengers or employees onboard, whilst the cruise is ongoing, enabling the Travel Broker or Carrier to proceed with remedial and rectification measures. If necessary, the Travel Broker or Carrier may contact the Charterer during the cruise of any issues that need immediate attention and resolution. Post cruise claims that could have been dealt with during the cruise can be reasonably rejected by the Travel Broker and Carrier.
  • The Charterer shall provide IWOT in time and not less than 15 days (about 2 weeks) prior to embarkation, the full details of its passengers which should include:
  • Full Passport details, including surname, name, nationality, date of birth, passport number, and passport expiration date
  • Cabin allocation
  • Flight details in/out
  • Special needs of the passengers, such as movement disability, hearing aids, etc.
  • Dietary needs, allergies, etc.
  • It is the Charterer’s responsibility to comply with the Carriers prohibition of carriage of pets or animals of any kind.
  • It is the responsibility of the Charterer that all passengers should: (1) be at the Embarkation place one hour before departure, and (2) at the intermediate ports’ passengers should be on board the ship 15 minutes prior the scheduled and/or announced departure.
  • It is to the Charterers responsibility to organize passengers’ embarkation/disembarkation and the shore excursions (if implemented by the charterer) and other activities so that they coincide with the ship’s timetable as scheduled or adjusted on account of weather or other acts of God. Any delays of whatever nature and related expenses caused due to Charterer’s decision or acts of their passengers to prolong or shorten a port stay should be for Charterers’ account. Charterers should ensure and accept that the ship should always be at a safe berth or at a safe anchorage, always afloat at any time of tide.
  • If it appears to the captain at any time during the cruise that one or more passengers are becoming for any reason (including the consumption of alcohol or other substances) unfit to travel or likely to endanger the health, safety, or comfort of anyone on board then the captain may refuse to embark or disembark the guests at any port or place, transfer the guests from one suite to another, or otherwise deal with the guests as per the provisions of the local law. In such circumstances the passengers shall not be entitled to any refund or compensation and shall be liable to pay any fines, losses, or compensation due to any party.
  • The Carrier reserves the right at its sole option and discretion and that of the Captain of the ship, without liability for damages or refund of any kind, to alter or deviate from the ship’s scheduled or ordinary itinerary or route, either this is caused by weather conditions, Force Majeure, assisting other ships in distress, saving of life at sea or other extraordinary conditions. Such does not entitle the Charterers or their passengers to any claims or refunds. The Carrier will however ensure that passengers access their port or disembarkation on time for their outwards flights.
  • In the event of a circumstances beyond the Carriers control including Force Majeure, merely preventing the ship from the execution of its voyage -either as scheduled or as otherwise adjusted- for more than 48 hours, this agreement may be terminated and a refund equal to the outstanding days shall be returned to the Charterer.
  • During the cruise should the vessel sustain for Force Majeure reasons for more than 48 hours any breakdown in machinery, or be disabled by fire, grounding or collision disrupting the cruise itinerary for more than 48 hours, and if no substitute vessel or arrangement is offered, passengers will be entitled to a refund proportional to the cruise days not operated. No further claims or refunds will be applicable.
  • The guests shall knowingly and voluntarily assume the risk of and shall indemnify the Travel Broker against any claims made by him/her or on his/her behalf as a result of using equipment provided by the Travel Broker and participating in Off-Vessel Activities.
  • The guests shall acquire the training and skill necessary to participate in Off-Vessel Activities and shall follow the rules, guidance, directions, and procedures of the Travel Broker; and
  • The passenger shall indemnify and hold harmless IWorld of Travel/ Elixir Cruises/ Emerald Blue Cruises SA, from all disputes, actions, losses, damages, claims or liability for any personal injury, death, property damage or other loss, accident, delay, inconvenience or irregularity which is not occasioned by any negligent acts or omissions of IWorld of Travel/ Elixir Cruises / Emerald Blue Cruises SA, arising out of any goods or services provided for these trips or any component within.
  • The Charterer will approach sub charterers and asking to accept and agree of following text, at the time they pay for their cruise:
  • As a traveler, you are voluntarily participating in the trip with IWorld of Travel/ Elixir Cruises/ Emerald Blue Cruises SA, and as lawful consideration for the agreement to travel with IWorld of Travel/ Elixir Cruises / Emerald Blue cruises SA, you agree not to make a claim against IWorld of Travel/ Elixir Cruises/ Emerald Blue Cruises SA, its related companies, officers and employees for any injury or future medical condition, death, or any other claim and agree to release IWorld of Travel/ Elixir Cruises/ Emerald Blue Cruises SA, its related companies, directors, and employees from any such claim. This release is binding on all members of your party, estate and heirs, and this provision shall be enforceable at any future time. Responsibility is not accepted for losses or expenses due to illness or injury, lack of appropriate medical facilities or availability of qualified medical practitioners, adverse weather conditions, strikes, criminal acts including theft or otherwise, war situations, terrorism or threat of terrorism, computer system issues, or any other such causes. Other risks may arise such as, but not limited to, the hazards of travelling in any worldwide country including undeveloped areas, the general hazards when travelling by aircraft, van, coach, train, ship, automobile, or other motorized vehicle, differing standards of safety, sickness, criminal acts committed by others, allergic reactions including encounters with animals. IWorld of Travel/ Elixir Cruises/ Emerald Blue Cruises SA is not responsible for, and will not be bound by, representations made by third party representatives, travel agents, unaffiliated websites, or any other third party. Payment of the deposit to IWorld of Travel constitutes acceptance of our terms and conditions. The charterer undertakes to make each guest agree to the above language in their T&C.

 

 

Omissions

IWOT is not responsible for omissions, printing and/or presentation errors in brochures, on Internet sites, or in any other media where such information may be presented. IWOT reserves the right to make corrections as required. Agreement: The payment of a deposit and/or the issuance of tickets or vouchers shall be deemed your consent to the Terms and Conditions as presented herein.

 

 

 

Claims

All claims including, without limitation, any failure to provide a service forming part of the Cruise or any additional service paid or any property damage, loss, or injury, illness, or death, should be immediately notified to the Travel Broker and confirm this in

writing at the earliest possible opportunity and not later than 30 days from occurrence, failing which the Travel Broker shall be under no liability under this contract.

 

 

Attorney Fee Provision

This agreement is deemed to be entered into in New York, NY. The exclusive venue for any action concerning the interpretation, enforcement, or breach of any term, obligation, or duty as contained or related to these Terms and Conditions or any grievance relating to the trip shall be solely in the Superior Court of New York, New York County (Manhattan). This Agreement shall be construed according to the internal laws of New York without regard to conflicts of law principles. All claims must be submitted in writing and received by IWOT no later than 30 days after completion of your trip. Claims not submitted and received within this time shall be deemed to be waived and barred. In any legal action, arbitration, or other proceeding to enforce, interpret, or construe the terms of this Agreement, or concerning any grievance related to your trip and services, the prevailing party shall be entitled to recover actual reasonable attorneys’ fees, costs, and expenses.

 

 

Time of Publishing

The effective date of the Terms & Conditions is 12/13/23, and all commitments prior to the effective date will be honored at the rates of the Terms & Conditions at the time of commitment.
